Does the law apply to you?

Fire safety duties under Part 3 of the Fire (Scotland) Act 2005 apply to relevant premises. Section 78 defines these as any premises, apart from a short list of exclusions.

Premises include Section 78(3)
  • Any place, including buildings and open sites
  • Any installation on land
  • Tents and movable structures
  • Ships, other than those excluded, and vehicles that are not road-registered or used as transport
Not relevant premises Section 78(2)
  • Private homes, and the stairs, passages and gardens they share
  • Mines and offshore installations
  • Ships during normal crew-only activities
  • Borehole sites
  • Farm or forestry land away from the main buildings
Homes that still count Section 78(5)
  • Houses in Multiple Occupation (HMOs) needing a licence under Part 5 of the Housing (Scotland) Act 2006
  • Care home services
  • School care accommodation
  • Independent health care services
  • Secure accommodation
  • Child minding premises

In short: generally, all workplaces in Scotland are deemed to be relevant premises. If you employ people, run a business or have control of a building that is not a private home, the law is very likely to apply to you.

How an assessment works

  1. Get in touch

Tell us about the premises. We confirm the scope and send you a quote.

  2. Site visit

A thorough walk round, a look at your records, and a conversation with the people who run the building.

  3. Your report

A written assessment and action plan, with photographs, in Word and PDF.

  4. Follow up

Questions answered, actions checked off, and reviews booked when things change.

As the duty holder you are responsible for carrying out a fire safety risk assessment and putting the right fire safety measures in place. Our reports are written to help you meet those duties.

Part 3, Fire (Scotland) Act 2005 | Fire Safety (Scotland) Regulations 2006 (SSI 2006/456) Read our guide to the legislation

Important: The fire risk assessment, and the fire safety of your premises, remain your responsibility as the duty holder. Having a fire risk assessment is not enough on its own. Any areas of improvement must be addressed, within the timescales given, for you to meet your legal duties.
